These terms apply to website hosting, domain registration, email hosting, maintenance, and digital services provided by On Point Creative NT.

1. Service Provision

We provide website design, hosting, domain registration, email hosting, and related digital services either directly or via third-party wholesale providers.

Services may rely on external infrastructure providers.

2. Payments & Subscriptions

• Hosting and subscription services are billed in advance.
• Non-payment may result in suspension of services.
• Fees are non-refundable once a service period has commenced unless otherwise stated in writing.

3. Service Availability

While we aim to maintain reliable services:

• We do not guarantee uninterrupted availability.
• Scheduled maintenance or third-party outages may occur.
• We are not liable for downtime beyond our reasonable control.

4. Client Responsibilities

Clients are responsible for:

• Maintaining secure passwords
• Ensuring lawful use of hosting and email services
• Backing up their own website content unless covered under a maintenance agreement
• Not using services for spam, illegal, or malicious activity

5. Suspension & Termination

We reserve the right to suspend or terminate services where:

• Payments are overdue
• Services are used unlawfully
• Activity poses security risks

Termination may result in websites or email services going offline.

6. Data & Backups

Where backups are included in a hosting plan:

• Backups are provided as a safeguard, not a guarantee.
• Clients remain responsible for their own data.
• Restoration services may incur fees if outside maintenance scope.

7. Domain Registration

Domain registration services are subject to registry rules and third-party provider terms.

Failure to renew domains may result in loss of ownership.

8. Limitation of Liability (Services)

To the maximum extent permitted by law:

• Our liability is limited to the fees paid for the affected service period.
• We are not liable for loss of profits, business interruption, or consequential damages.

9. Australian Consumer Law
